This contest is sponsored by Bluegreen Vacations Unlimited, Inc. d/b/a Bluegreen Resorts 4960 Conference Way North, Suite 100, Boca Raton, FL 33431 and grants each person who submits an original photograph or video taken at a Bluegreen Resort between February 1, 2011 and April 22, 2011 a chance to win one of 12 prizes. Prizes: One Video Grand Prize: A Visa reward card in the amount of $500.00 with a retail value of $500.00 and an estimated odds of winning of 1:100,000; One Photo Grand Prize: A Visa reward card in the amount of $500.00 with a retail value of $500.00 and an estimated odds of winning of 1:100,000; Five Video Runner Up Prizes: Each video runner up winner will receive a Visa reward card worth $100.00 with a retail value of $100.00 and an estimated odds of winning of 1:20,000; Five Photo Runner Up Prizes: Each photo runner up winner will receive a Visa reward card worth $100.00 with a retail value of $100.00 and an estimated odds of winning of 1:20,000. Actual odds will depend upon total number of entries and videos and/or photographs received. Terms and conditions may apply. Official Contest Rules. 1.) This promotion is sponsored by Bluegreen Vacations Unlimited, Inc., 4960 Conference Way North, Suite 100, Boca Raton, FL 33431, the developer of Bluegreen Vacation Club, a registered multi-site timeshare plan in Florida and elsewhere. 2.) To Enter: Entrants must have vacationed at one of Bluegreen's resorts between 01/01/2005 and 04/21/2011. All entries must be original videos less than 120 seconds in length and/or photographs taken by entrants during their stay at the resort. Videos and/or photographs may not be retouched and may not be digitally altered. Entrants may submit a maximum of three videos and/or photographs. All photographs must be submitted with a single entry. All submitted videos and/or photographs shall become the sole and exclusive property of Bluegreen Resorts and may be reproduced, copied, modified, displayed, printed published and/or used by Bluegreen Resorts, royalty free, at any time(s) and in any manner(s) it chooses. Any video and/or photographic entries that have been retouched or altered, including without limitation any video and/or photographic entries found to have had objects added to them or deleted from them will be immediately disqualified. Use of digital filters and effects is not allowed. Bluegreen Resorts determination as to whether any video and/or photograph should be disqualified shall be in its sole good faith discretion, final and binding. Videos and/or photographs may be disqualified for any good faith reason including, but not limited to, belief that they have been retouched or altered, privacy considerations, intellectual property rights and other factors. 3.) Entries will be judged by a panel of 6 Colorful Places editors. The top 30 entries will be posted on the Colorful Places web site at www.colorfulplaces.com. Visitors to the web site will vote on their favorite video and/or photograph (visitors may vote more than once). The videos and/or photographs with the most votes will win. In the event of a tie, Colorful Places editors will make the final decision. 4.) Entrants must be 18 years of age or older. Entry and Release forms must be completely filled out to be eligible. ONLY UP TO THREE VIDEOS AND/OR PHOTOGRAPHS AND ONE ENTRY PER PERSON/HOUSEHOLD. Employees, officers, directors, agents and their immediate family and non-related household members of Sponsor, Sponsor's parent company, affiliates and agents are not eligible to participate in this contest. 5.) Winners will be determined by September 20, 2011. 6.) Prizes will be sent to winners via USPS on or about September 30, 2011. Any unclaimed/unused prizes will be considered forfeited and another winner will not be chosen. 7.) All entrants agree to be contacted and given the opportunity to purchase discount vacation packages and/or other items from sponsor, sponsor's affiliates, sponsor's marketing partners and unaffiliated entities with which Sponsor may conduct or transact business.
Prior to claiming any prize, and in order to be eligible for that prize, winners must sign a video and/or photography release assigning the publicity and intellectual property rights over to Bluegreen for advertising and promotional purposes without additional compensation, unless prohibited by law.
Neither Sponsor, Sponsors' parent company, Bluegreen Corporation, nor any of their respective subsidiaries, affiliates, employees, officers, directors, shareholders, and/or agents (collectively "Related Parties") shall be responsible for (and none will be liable for): (i) late, lost, damaged, misdirected, incomplete, unintelligible entries; (ii) telephone, electronic, hardware or software program, network, Internet or computer malfunctions or transmission failures of any kind; (iii) any condition caused by events beyond the control of Sponsors that may cause Sweepstakes to be disrupted or corrupted; or (iv) any printing or typographical errors in any Sweepstakes materials. (v) any innocent error or conduct in connection with this promotion: (vi) any good faith judgment or use of discretion. Sponsor shall have the right but not the obligation to disqualify any entries that sponsor believes, in its good faith but sole discretion, are fraudulent or otherwise improper or tainted. Indemnification: By participating you agree to release, indemnify, defend & hold the Related Parties, harmless from any & all losses, damages, injuries, rights, claims & actions, of any kind including without limitation, personal injury, death & property damage, & claims based on publicity rights, intellectual property rights, defamation or invasion of privacy (including attorneys' fees), in whole or in part, directly or indirectly, in connection with (i) the Sweepstakes; (ii) the use, display, reproduction, copying, modification or printing of the photographs you submit; (iii) or acceptance, possession, use or misuse of any prizes.
